California Gambling and Control System

The foundation for gambling in California has been set up through constitutional amendment and rather than by legislative structure. Even the State Lottery system and horse racing have been enacted by the amendment to make it legalized. Prior to 1982, five major legislative proposals were made to make the lottery system legalized but all of them went through certain reproof. In 1982, despite a budget shortfall, Governor Deukmejian announced he would denounce the lottery bill, even if it made to pass through. However, despite the legislative restriction, a pro-lottery coalition had ultimately succeeded to qualify the measure and earn passage. Despite the political outcry and disapprobation from the governor, attorney general, and the Protestant leaders, the measure was finally passed.

In 1984, “Gaming Registration Act” was enacted. This act required the attorney general to provide a uniform and minimum regulation of California card rooms. But later the council enacted the “Gaming Control Act” after realizing the attorney general’s limited scope for regulation coupled with inadequate fund. In fact, this political turmoil continued till 1998 when the gambling industry was not regulated properly. In 2000, the situation turned a little better when Proposition 1A was pledged by California voters to amend the constitution to authorize Class III or Casino Style Indian Gambling to be conducted with mutual conformity and authorization of the tribal communities and the state. The “Gambling Control Act” was later created to structure a simplified and comprehensive policy for all state to legalize and regulate gambling. The entire commission was a ramified chamber of the Division of Gambling Control within the attorney general’s office and the California Gambling Control Commission with a board of five members appointed by the Governor. In early 2007, the Division was replaced by Bureau within the Department of Justice’s Division of Law Enforcement. The Bureau of Gambling Control regulates the integrity of gambling by ensuring it free from criminal and corruptive elements.
